United States · Texas counterclaims and statutory limitations
When must an otherwise-barred Texas counterclaim or cross claim be filed?
A party may file an otherwise-barred counterclaim or cross claim under CPRC 16.069 when it arises from the same transaction or occurrence as the action. The claim must be filed no later than thirty days after the date the party’s answer is required. This calculator uses that independently established required date, not actual answer filing, and does not decide statutory eligibility.
- Period
- Thirty calendar days after the independently established required answer date
- Trigger
- The date on which this party’s answer is actually required under the governing procedure
- Rule
- Texas CPRC 16.069(a)–(b)

Which required answer date starts this statutory period?
Establish that the proposed counterclaim or cross claim arises from the same transaction or occurrence as the action.
Obtain the governing citation, procedural rule and actual records establishing when this party’s answer is required.
Distinguish the answer-required date from actual answer filing, service, drafting and the underlying cause’s accrual.
Texas CPRC 16.069(a)–(b)How is the qualifying thirty-day filing period counted?
- Establish that the proposed counterclaim or cross claim arises from the same transaction or occurrence as the action.
- Obtain the governing citation, procedural rule and actual records establishing when this party’s answer is required.
- Exclude the established answer-required date and count thirty calendar days.
- Check the actual county opening and file the qualifying claim with the proper clerk.
Exclude the independently established answer-required date and count thirty calendar days. Rule 4 and Government Code 311.014 address event exclusion and computation. This calculator does not derive the underlying answer date or make an unrelated claim eligible.
CPRC 16.072 addresses statutory suit-filing periods ending on Saturday, Sunday or holiday by extending to the next day county offices are open. Rule 4 and Government Code 311.014 also address final weekends and legal holidays. The encoded Texas calendar covers 2026 through 2028. Establish the actual county opening, additional closure and governing treatment. The closed-day example expressly assumes county offices are open September 7, 2027.
Texas Rule 4What does an independently derived qualifying example show?
Fictitious example
Fictitious facts. The governing procedure independently establishes this party’s required answer date as August 2, 2027. This is an eligible same-transaction claim otherwise barred as a separate action at that date. No additional closure applies. The example does not infer every answer date from the ordinary Rule 99 command.
| Step | What is counted | Date |
|---|---|---|
| Established event | The party’s answer is required under the actual governing procedure | August 2, 2027 |
| Ordinary period | Exclude the required answer date and count thirty calendar days | Wednesday, September 1, 2027 |
Fictitious eligible claim and independently established required answer date. The separate closed-day example assumes county offices open September 7, 2027. The calculation does not decide statutory eligibility, the underlying answer procedure or a disputed county calendar.
Try these dates in the calculatorWhich statutory and pleading conditions must be established?
- Same transaction or occurrence
- Section 16.069(a) requires the counterclaim or cross claim to arise out of the same transaction or occurrence that forms the basis of the action. Thirty days does not revive an unrelated otherwise-barred claim.
- Otherwise barred at the required answer date
- The statutory branch permits the qualifying claim even though it would be barred as a separate action on the date the party’s answer is required. Establish actual claim classification and limitations facts; a calculation does not determine them.
- Required answer differs from actual filing
- Section 16.069(b) measures from when the answer is required. Filing an answer earlier or later does not itself replace that date. An ordinary Rule 99 answer has its separate service, Monday-next and 10:00 a.m. command, which this thirty-day preset does not calculate.
- Pleading relation back is a different provision
- Section 16.068 concerns subsequent amendment or supplement of a pleading that was not subject to limitation when filed, with its different-transaction exception. Do not replace the specific 16.069 answer-required trigger with an assumed relation-back event.
- This calculator does not decide whether two claims arise from the same transaction or occurrence, the merits or judicial application to contested facts.
- It does not establish the underlying required answer date, relation back, historical applicability or actual filing sufficiency.

Common questions about the counterclaim filing branch
Counterclaim and cross-claim eligibility and filing
Does filing my answer begin the thirty days?
Section 16.069(b) uses the date the answer is required, not simply when the answer was actually filed.
Texas CPRC 16.069(b)Does the statute save an unrelated expired claim?
The branch requires the same transaction or occurrence forming the basis of the action. Establish that condition separately.
Texas CPRC 16.069(a)Does this determine my original answer deadline?
No. Establish the required answer date under its governing citation and procedure. Ordinary Rule 99 answers have their own named-weekday and specified-hour requirements.
