When is a late-received Texas civil filing timely under the mailbox rule?

Rule 5 treats a covered document as timely if it is sent to the proper clerk by first-class United States mail, properly addressed and stamped, deposited on or before the filing deadline, and received by the clerk no more than ten days late. Ten days is a receipt condition, not permission to deposit late. This guide calculates no separate filing date.

Which facts and events control this procedure?

Establish the actual filing deadline under the applicable rule, order and facts.

Obtain proof of first-class United States mail deposit, postage, address and the proper clerk.

Obtain the clerk’s actual receipt record and retained envelope or legible USPS postmark.

Texas Rule 5

How does the required timing work?

  1. Establish the actual filing deadline under the applicable rule, order and facts.
  2. Both timely deposit and bounded actual receipt must hold. The ten-day receipt condition relates to lateness after the established filing deadline, not an arbitrary date a party chooses to mail. A standalone ten-day calculation cannot prove the combined conditions or extend the original deposit date.
  3. Read the actual order and confirm every stated condition.
  4. Complete the act required by the rule, not merely a date calculation.

Establish the actual original deadline and applicable Rule 4 treatment. This guide does not create a closed-day extension to a presumed receipt date or use ten days as a new mailing period. Actual clerk receipt and every stated mail condition must be checked.

Texas Rule 5

Why is no fixed date calculated?

The isolated ten-day preset does not establish timely original deposit, proper clerk, qualifying mail or actual receipt. No separate filing date or paid record is calculated.

Which conditions, exceptions or court directions matter?

Specific mail and proper destination
The filing must be sent to the proper clerk by first-class United States mail in a properly addressed and stamped envelope or wrapper. Merely sending a document to opposing counsel does not file it with the clerk.
Deposit is due by the original deadline
Rule 5 requires mail deposit on or before the last day for filing. Its ten-day receipt condition does not authorize depositing the filing ten days late.
Court enlargement is a separate branch
Rule 5 separately distinguishes enlargement sought before expiry from permission after expiry on good cause. It restricts enlargement of new-trial action periods except as provided in the rules. A requested enlargement is not an actual granted order.
Texas Rule 5
  • This guide does not establish the actual pleadings, service, calendar, legal entitlement or terms of a signed order.
  • The current consolidation date does not decide historical applicability of an individual amendment.
