Texas Rule 21(b)How does the required timing work?
- Obtain the actual proceeding setting, time, location or remote access instructions.
- Preserve at least the required interval before the proceeding’s specified time. Rule 4 excludes intermediate Saturdays, Sundays and legal holidays for periods of five days or less, except its expressly described mail-extension periods in Rules 21 and 21a. Do not treat the independent Rule 21(b) notice interval as the Rule 21a(c) mail add-on. The guide makes no automatic backward closed-day adjustment.
- Read the actual order and confirm every stated condition.
- Complete the act required by the rule, not merely a date calculation.
The encoded short-period interpretation and backward endpoint require separate assessment of Rule 4, the actual proceeding and any specific rule or order. This guide does not resolve disputed local application by showing a calculated service date.
Texas Rule 21(b)Why is no fixed date calculated?
The general three-day preset does not establish the more specific rule, actual shortening, complete service, time-of-day notice or backward closed-day endpoint. No date or paid record is calculated.
Which conditions, exceptions or court directions matter?
- A more specific rule or shortening can control
- Rule 21(b) expressly yields to another provision in the rules or a period shortened by the court. A requested shortening alone is not proof that the court granted it.
- Participation information is substantive notice content
- The notice must give participants the information needed to take part, including location or electronic joining instructions, the court’s designated contact information and evidence-submission instructions. The court must publish needed participation information.
- Service proof is separate from filing
- Rule 21(a), (c)–(d) and Rule 21a address written filing where required, service on other parties and signed certification. The notice interval concerns actual service, not an assumed docket filing event.
- This guide does not establish the actual pleadings, service, calendar, legal entitlement or terms of a signed order.
- The current consolidation date does not decide historical applicability of an individual amendment.
