Texas Rule 330(a)How does the required timing work?
- Establish the district court’s eligibility under Rule 330 and the appeal’s actual procedural route.
- Identify expiry of twenty days after the appeal was filed in district court, then apply Monday next after expiry and the 10:00 a.m. command. Do not count from rendition below or replace the two-stage command with filing plus twenty days.
- Read the actual order and confirm every stated condition.
- Complete the act required by the rule, not merely a date calculation.
Rule 4 excludes the triggering event and counts intermediate calendar days for periods longer than five days. It addresses final Saturdays, Sundays and legal holidays. This guide calculates no final date or hour, and does not replace a named-weekday step, actual court order or required receipt with an isolated period. Establish the applicable legal holidays and actual court calendar.
Texas Rule 330(a)Why is no fixed date calculated?
The encoded twenty-day base does not calculate the Monday-next stage or the specified hour. Eligibility also requires the actual Rule 330 court. No computed date or paid record is published.
Which conditions, exceptions or court directions matter?
- Only the district courts described in Rule 330
- Rule 330 applies where the county’s only district court with civil jurisdiction, or all its district courts with civil jurisdiction, have successive year-round terms with no more than two days between terms. Establish the actual court and county eligibility. The provision does not describe every justice-court appeal or every district court.
- Appellant and appellee have different events
- The appellant’s appeal including transcript is filed within thirty days after rendition. The appellee’s appearance or answer instead uses the date the appeal is filed in district court.
- Specified hour remains
- The rule states 10:00 a.m. Electronic filing’s ordinary midnight boundary does not replace a specified time of day.
- This guide does not establish the actual pleadings, service, calendar, legal entitlement or terms of a signed order.
- The current consolidation date does not decide historical applicability of an individual amendment.
